JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 397/412 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, on the basis of call details, it was detected that this petitioner was using stolen mobile and, after that, police submitted charge sheet against the petitioner, showing him absconder.

No doubt, the occurrence appears to have taken place in the year, 2010 and the petitioner could be remanded in this case on 05-05-2016 but taking into consideration the facts and

No.34290 of 2016 (2) dt.20-08-2016 2/2 circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sugauli (Motihari) Rail P.S. Case No. 48 of 2010 to the satisfaction of learned Railway Judicial Magistrate, Bettiah, West Champaran.
