The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code, section 27 of the Arms Act, Rules 11/56 of Bihar Minerals (CPTS) Rule, 2019 and section 15 of the Environment Protection Act, 1986.

As per the prosecution case, on receiving information about illegal mining of sand and earth, it is stated by the informant that he along with homeguard reached at the spot and found seven tractors loaded with sand and earth. It is stated that the accused persons surrounded the informant and his

Patna High Court CR. MISC. No.28958 of 2021(2) dt.06-12-2021 2/3 team, broke the glasses of their vehicles and assaulted them. The accused persons were addressing each other with names of Pappu Singh, Kare Singh, Subodh etc.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He has been falsely implicated in the case. Referring to the order of the learned court below, it is submitted that the name of the petitioner transpired in course of investigation. He is said to be identified in the video clip. The petitioner has not been put on T.I. parade and is in custody since 27.12.2020. He has no criminal antecedent and chargesheet has been submitted in the case. Another co-accused namely Raushan Kumar has been enlarged on bail vide order dated 16.11.2021 passed in Cr. Misc. no.24948 of 2021.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to the aforesaid co-accused Raushan Kumar, the petitioner having remained in custody for 11 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Matihani P.S. Case no.168 of 2020 on furnishing bail bond of Rs.10,000/

Patna High Court CR. MISC. No.28958 of 2021(2) dt.06-12-2021 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist, Begusarai.
