Petitioner seeks bail in a case registered under sections 409, 420 and 188 of the Indian Penal Code.

Petitioner being headmaster took advance of Rs 8, 67, 456/- for construction of the school building and spent only Rs 2, 65, 565/- towards construction work and allegedly, misappropriated Rs 6, 01, 091/-.

Submission on behalf of the petitioner is that petitioner has already completed work up to advanced amount as brother of the petitioner sought information from District Programme Officer who reported that work of ceiling has been completed. The impugned order goes to show that in course of investigation, I.O found that work of ceiling has not been completed and report of the District Programme

Patna High Court Cr.Misc. No.34138 of 2016 (2) dt.19-08-2016 Officer goes to show that work of ceiling has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in Piparahi P.S. Case no. 07/2016.
