JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 This application, for grant of anticipatory bail, arises out of Sugauli P.S. Case No. 185 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 353, 436, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of instigating others to assault the informant, upon which other accused persons assaulted the informant and others.

Submission of learned counsel for the petitioner is that save and except allegation that he is order giver, there is no allegation against him and the accused persons having similar allegation has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 08.02.2019 passed in Cr. Misc. No. 7440 of 2019. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Sugauli P.S. Case No. 185 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
