The Juvenile / petitioner has challenged the order of the Juvenile Justice Board as also of the Children Court, whereby the prayer for release of the Juvenile / petitioner from Remand Home has been rejected on the ground of the fears of the courts below regarding the petitioner falling in bad company if released from Remand Home.
It has been submitted on behalf of the petitioner / Juvenile that though he has been made accused in a case involving Arms Act and other Sections of the Indian Penal
Patna High Court CR. REV. No.342 of 2020(2) dt.24-06-2020 2/3 Code but there is no recovery of any firearm weapon from his possession.
It has further been submitted that the Social Investigation Report mentions about his bad conduct but only on the basis of the statement given by his neighbours. The assessment of the courts below with respect to the criminal proclivity of the petitioner is absolutely unfounded. The petitioner is in Remand Home since 14.10.2019.
The father of the petitioner is ready and willing to furnish bonds and an additional affidavit indicating that he shall take good care of his son.
Regard being had to the aforesaid submissions on behalf of the Juvenile / petitioner, he is directed to be released on bail from the Remand Home on his father furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Juvenile Justice Board, Gaya in connection with Chapra Muffasil P. S. Case No. 403 of 2019.
Patna High Court CR. REV. No.342 of 2020(2) dt.24-06-2020 3/3 At the time of furnishing of bond, the father of the petitioner shall furnish an affidavit clearly indicating that he shall keep the petitioner under close supervision and shall not permit him to go astray.
The revision petition stands disposed off accordingly.
