JUSTICE BIRENDRA KUMAR ORAL ORDER 19-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Karakat P.S. Case No.98 of 2016, a case under Sections 366A/376/34 of the Indian Penal Code and Section 4 of the POCSO Act.

Submission of the learned counsel for the petitioner is that the petitioner had love-affairs with the informant and both had married before the Registrar Marriage on 25.05.2016 vide Annexure-2. Thereafter, under the pressure of the parents the wife of this petitioner lodged the present case alleging therein that the petitioner, who was in talking term with her, forcefully took her to Gujarat and for seven months sexually exploited her.

No.3952 of 2018 (2) dt.19-01-2018 P2/ Considering the entire facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
