JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2016 A supplementary affidavit has been filed on behalf of the petitioner which is kept on record.
This is the second attempt for regular bail on behalf of the petitioner. The earlier bail application of the petitioner was rejected vide Cr.Misc.No.17151 of 2016 with the observation that the same is rejected for the present. The petitioner is in custody since 03.04.2016 and now the chargesheet has been submitted in the case which is Annexure-9 to the supplementary affidavit. The name of the petitioner has figured on the basis of a confession of a co-accused where it has been alleged that the JCB machine of the petitioner was used by the extremists. Except for the confession made by the co-accused, there is no other substantive material to suggest the implication of the petitioner in the present case. The
Patna High Court Cr.Misc. No.26454 of 2016 (2) dt.13-07-2016 other co-accused persons have also been granted regular bail by this Court vide Cr.Misc.No.21759 of 2016 and 22173 of 2016. On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rsa.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Aurangabad in connection with Madanpur P.S.Case No.42 of 2016.
