JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 304(B) and 201/34 of the I.P.C. and Sections 3⁄4 of the Dowry Prohibition Act.
Allegation is that the accused persons including the petitioner have tortured and ultimately killed the informant's daughter due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.4.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Patna High Court Cr.Misc. No.30468 of 2016 (3) dt.22-09-2016 16 and 29 of the case diary, it is evident that the deceased had died due to prolonged illness.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town (Kadirganj) P.S. case No.72 of 2015.
