2. The petitioner has preferred this application for grant of regular bail in connection with G.B. Nagar P.S. Case No. 618 of 2024 dated 02.12.2024 registered for the offences punishable u/s 80(2), 238 read with 3(5) of the B.N.S.
3. As per the prosecution case, all the accused persons including the petitioners are alleged to have killed and burnt the dead body of the informant's sister due to non-fulfillment of demand of dowry of Rs. 3 lacs out of which Rs. 1 lac and one Splendor motorcycle were already given to them.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in
Patna High Court CR. MISC. No.18637 of 2025(2) dt.23-04-2025 2/2 this case due to suspicion. The petitioner no. 1 is the devar, the petitioner no. 2 is the bhaisur and the petitioner no. 3 is mother-inlaw of the deceased. He further submits that petitioners are living separately from the deceased and her husband. They have no concern with the affairs of the deceased and her husband. There is general and omnibus allegation against the petitioner. The informant was also present there at the time of death and cremation of the deceased. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 03.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan in connection with G.B. Nagar P.S. Case No. 618 of 2024.
7. The application stands allowed.
