Mr. SRI BHARAT BHUSHAN ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with NDPS Case no. 14 of 2017 arising out of Bhabua P.S. Case no. 552 of 2017 registered for the offences punishable under Sections 20(B) (II) (c) . 22 and 27(A) of the Indian Penal Code. Allegation is that on secret information police went to the house of Shri Krishna Singh and found petitioner there. Police seized 34.5 Kg. Ganja from there and on query it is revealed that he used to sell Ganja with the help of one Birendra Singh. It is submitted on behalf of the petitioner that recovery of Ganja was not made from the conscious possession of the petitioner rather from the farm house of Shri Krishna Singh where articles for the purpose of agriculture were kept. Petitioner has been falsely implicated in the present case. He is
Patna High Court Cr.Misc. No.858 of 2018(3) dt.02-02-2018 2/2 is an old man and in no way concern with the seized Ganja. He has clean antecedent and is in jail custody since 08.09.2017.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Kaimur at Bhabua, in connection with NDPS Case No. 14 of 2017 arising out of Bhabua P. S. Case no. 552 of 2017.
