2. The petitioner seeks regular bail in connection with Sigori P.S. Case No. 83 of 2023 registered under Sections 147, 148, 149, 341, 323, 302 and 120(B) of the I.P.C.
3. As per prosecution case, it is alleged that due to long property dispute, 13 named accused persons assaulted the informant's mother with fists, kicks, lathi etc., who during course of treatment by village doctor succumbed to her injuries.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to family property dispute. The alleged occurrence took place on 28.05.2023 but the F.I.R. has been lodged after death of the mother of informant on 02.06.2023. There is general and omnibus allegation against 13 accused persons
Patna High Court CR. MISC. No. 23348 of 2024(2) dt.20-03-2024 2/2 including the petitioner. In post-mortem report, the cause of death of the deceased was kept reserved. The petitioner is in custody since 18.10.2023. The charge sheet has already been submitted. There is no chance of absconding or tampering with the evidence by the petitioner. He further submits that the similarly situated co-accused person, namely, Anju Devi has been granted regular bail by this Court vide order dated 29.01.2024 passed in Cr. Misc. No. 2171 of 2024.
5. Learned A.P.P. opposes the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case, submissions of the parties and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Sigori P.S. Case No.83 of 2023.
