====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Teghra P.S. Case No. 236 of 2018 registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving the secret information about keeping the illicit Indian Made Foreign Liquor by Roshan Kumar, Gorey Lal Mahto and Nirmal Kumar in village-Barauni in the field, the informant being the A.S.I. of Police Station-Teghra along with other police officials, proceeded for Sahuara and on seeing them, 4-5 persons started to flee away but on chase, three persons were apprehended, who disclosed their name as Laxman Mahto alias Bhadai Mahto

Patna High Court Cr.Misc. No.62320 of 2018(2) dt.06-10-2018 2/2 (petitioner), Gayatri Devi, wife of the petitioner, and Nilam Devi, wife of Arjun Singh. From the field of Nilam Devi and Roshan Kumar, 280 liters Indian Made Foreign Liquor was recovered.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case and it would appear from the F.I.R. that the alleged liquor was not recovered from the filed of the petitioner. The petitioner having no criminal antecedent is in custody since 27.06.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Jude-II-cumSpecial Judge, Excise, Begusarai. in connection with Teghra P.S. Case No. 236 of 2018.
