JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents and brother and sisters of the husband of the complainant are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands.

It is submitted by learned counsel for the petitioners that the accusation is not specific against these petitioners and the husband of the complainant has been granted regular bail on the

Patna High Court Cr.Misc. No.43103 of 2014 (2) dt.05-02-2015 2/2 undertaking that he will keep the complainant as wife with full dignity and honour.

It is submitted by the learned counsel for the complainant that the accusation of torture is also levelled against the petitioners.

Considering the fact that the husband of the complainant has been granted bail, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Gaya in connection with Complaint Case No. 1201 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
