Petitioner is in custody in connection with Sessions Trial No. 249 of 2019 (Asarganj P.S. Case No. 139/2018) for the offence under sectionss 307, 353/34 of the Indian Penal Code and Section 25(1-B) a 26, 35 and 27 of the Arms Act. Learned counsel for the petitioner submits that name of the petitioner was disclosed by Vivek Kumar @ Vivek Yadav. Learned counsel for the petitioner submits that petitioner is in custody since 24.6.2019 whereas Vivek Kumar who disclosed the name of the petitioner has been granted bail in this case.
Considering the fact that petitioner has remained in custody for nearly 11 months, the Court is inclined to grant bail
Patna High Court CR. MISC. No.17648 of 2020(2) dt.02-06-2020 2/2 to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned IVth Additional Sessions Judge, Munger, in connection with S.T. No. 249 of 2019 arising out of Asarganj P.S. Case No. 139 of 2018 subject to the condition that on release the petitioner shall render his service as volunteer for a period of one month to combat pandemic Covid-19 and as such he is required to report to the Nodal Officer, Munger who shall utilize the service of the petitioner appropriately.
