Learned counsel for the petitioners seeks permission to withdraw this petition with respect to petitioner No. 3/Banarsi Prasad as he has died during the pendency of the present petition. Permission is accorded.
The application with respect to petitioner No. 3 is dismissed as withdrawn as having become infructuous.
Petitioner Nos. 1 and 2, who are father-in-law and mother-inlaw of the informant respectively, seek bail in anticipation of their arrest in connection with Mahila P.S. Case No. 29 of 2019 instituted for the offences under Sections 354(A), 498(A) and 313/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. It has been submitted on behalf of the petitioners that they have been made accused in this case only because they are the parents of the husband of the informant with whom she could not live properly. The petitioners stay separately from their son and have got no concern with his affairs.
Considering the facts afore-stated, petitioner Nos. 1 and 2 above-named, in the event of their arrest/surrender before the Court below within a period of six weeks from today, are directed to be
released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Lakhisarai in connection Mahila P.S. Case No. 29 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
