Gita Devi who was married with Sonu Kewat, son of petitioner, was done to death at her Sasural and as per postmortem report, the cause of death happens to be presence of ante-mortem injury over her person. Furthermore, from the written report, it is evident that allegation has been attributed by the deceased while she was alive against her husband who was torturing her for procurement of a motorcycle. However, the informant, father of deceased had also pinpointed, apart from husband, petitioner and other family members.

Husband is under custody as is evident from para-15 of the petition.

Considering the nature of allegation inconsonance with the period of detention since 05.01.2016, petitioner Shyam

Patna High Court Cr.Misc.
