2. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 336(A) of the Indian Penal Code.

3. As per the prosecution story, the informant namely, Vijay Kumar alleged that on 11.8.2018 at 11:00 AM, his daughter, Khusboo Kumari went to Kumharar Park in Patna with her cousin and while strolling, she went missing and could not be found. The informant suspects that their tenant, Anil Kumar (Petitioner) kidnapped his daughter with intent to marry her.

4. Learned counsel for the petitioners submits that they have been falsely implicated in this case. He further

Patna High Court CR. MISC. No.21478 of 2025(3) dt.10-07-2025 2/2 submits that during investigation, the victim girl was recovered and in her statement recorded under Section 164 of the Cr. P.C., she denied the factum of kidnapping and stated that she solemnized marriage with the petitioner out of her own will and is living with the petitioner happily. The Court below has assessed the age of the victim as 20 years. Petitioner claims clean antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and the statement of the girl recorded under Sections 164 Cr. P.C., in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, III, Patna City, Patna in connection with Agamkuan P.S. Case No. 566/2018 subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
