Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Akbarpur P.S. Case No. 769 of 2020 for the offence punishable under Section 30(a) (c) of the Bihar Prohibition & Excise Act, 2016.

It has been submitted that the cabin from which the liquor was recovered does not belong to the petitioner and it is a public place, inasmuch as, there is no material to connect the petitioner with the said cabin. It has also been submitted that the petitioner has clean antecedent.

Considering the aforesaid facts, this application is allowed.

No.19845 of 2022(2) dt.22-04-2022 2/2 Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-cum-Special Judge, Nawada, in connection with Akbarpur P.S. Case No. 769 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is also subject to the condition that after grant of anticipatory bail the petitioner will mark his attendance in Akbarpur Police Station, District- Nawada on the first Sunday of every month during the trial. In failure to do so on consecutive dates, the bail bonds of the petitioner shall stand automatically cancelled.
