24-08-2016 Heard Sri Diwakar Yadav, learned counsel for the petitioner and Sri Suresh Prasad Singh, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 03-06-2016 in Gandhi Maidan P.S. Case No. 198 of 2016 registered for the offence under Sections 47(A) and 53(B) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail. Learned counsel for the petitioner submits that on false accusation showing recovery of few bottles of country-made and foreign liquor, the petitioner has been detained. Accordingly, a prayer has been made to grant bail, whereas, learned Addl. Public Prosecutor opposing the prayer for bail submits that the petitioner before the court below had suppressed the fact regarding
Patna High Court Cr.Misc. No.34865 of 2016 (2) dt.24-08-2016 2/2 his antecedent. He had disclosed that he was accused in only one case, whereas after perusal of the case diary, learned court below was satisfied that altogether nine cases were pending against the petitioner. The antecedent of the petitioner has also been mentioned in paragraph - 3 of the petition.
In view of antecedent of the petitioner, at the moment, I am not inclined to grant bail.
Dismissed.
