2. The petitioner is apprehending arrest in connection with Dhanarua P.S. Case No. 194 of 2023 dated 18.04.2023, lodged under Sections 413, 414, 420, 34 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against three named accused persons against whom there is an allegation that they have committed theft of motorcycle.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner is not named in the FIR and his name been figured in this case only by virtue of the confessional statement of the co-accused. Counsel further submits that nothing incriminating has been recovered from the petitioner's possession nor he was put on TIP. Counsel submits that during investigation,

No.32915 of 2024(4) dt.20-09-2024 2/2 petitioner was called by the police and interrogation took place for two days and after that, police did not arrest him, rather set him free. Counsel also submits that the criminal antecedent of the petitioner is clean and no material has come save and except suspicion.

5. Learned Counsel for the petitioner further submits that one of the co-accused person has been granted bail by this Court vide order dated 30.08.2023 passed in Cr. Misc. No. 56563 of 2023.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

7. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Masaurhi, Patna in connection with Dhanarua P.S. Case No. 194 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
