JUSTICE SUDHIR SINGH ORAL ORDER 14-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the I.P.C.
The allegation against the accused persons including the petitioner is of committing the murder of the husband of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.1.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is general and omnibus allegation against him. No specific injury has been attributed
Patna High Court Cr.Misc. No.30982 of 2016 (3) dt.14-09-2016 2/2 against the petitioner. The alleged occurrence is said to have taken place at 7.30 P.M. in the night. No source of identification has been disclosed by the informant. There is contradiction between the statement made in the F.I.R. and the statement made in course of investigation.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IX, Siwan in connection with Nautan P.S. case No.157 of 2015.
