Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. The petitioner is in custody since 04.03.2018. Earlier prayer for bail was refused on 24.04.2019 in Cr. Misc. No.6992 of 2019. The report of the trial Judge reveals

Patna High Court CR. MISC. No.19389 of 2020(3) dt.02-11-2020 2/2 that after examination of some prosecution witnesses one of the accused died and awaiting report of his death the trial is stagnant.

Considering the facts aforesaid especially the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.224 of 2018, arising out of Muffasil P.S. Case No.40 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
