2. The petitioner apprehends his arrest in connection with Gopalpur P.S. Case No. 152 of 2023, instituted under Sections 341, 323, 327, 379, 386, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner along with co-accused, who are sons of the informant, making pressure on him to sell his land and demanding rangdari from him.
4. Learned counsel for the petitioner submits that there is delay of 21 days in lodging the present F.I.R. without any explanation. Petitioner is son of informant and there is family dispute between the father and his two sons and with
Patna High Court CR. MISC. No.22079 of 2024(2) dt.22-04-2024 2/2 ulterior motives this F.I.R. has been lodged. Petitioner has one criminal antecedent in which he is on bail. He undertakes to cooperate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Gopalpur P.S. Case No. 152 of 2023, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
