The petitioner seeks bail in Udakishunganj P.S. Case No. 169 of 2017 registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
41.280 litres of foreign liquor and 148.600 litres of country made liquor are said to have been recovered from the Santro Car and the petitioner and another co-accused Mukesh Kumar Yadav @ Mukesh Kumar were apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. The petitioner does not happen to be either driver or owner of the car. He has no concern with the
Patna High Court Cr.Misc. No.2477 of 2018 (2) dt.23-01-2018 2/2 seized liquor. He has no criminal antecedent. He has been languishing in custody since 24.10.2017. Similarly situated coaccused, namely, Mukesh Kumar Yadav @ Mukesh Kumar has been enlarged on bail by a co-ordinate bench of this court vide order dated 18.01.2018 passed in Cr. Misc. No. 801 of 2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Magistrate, Udakishunganj, Madhepura in connection with Udakishunganj P.S. Case No. 169 of 2017.
