JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case was lodged against unknown persons. The informant disclosed the physical features of dacoits in his written report and the name of petitioner surfaced in this case in course of investigation, when the informant as well as some witnesses claimed to have seen the petitioner at the time of alleged occurrence.

Submission on behalf of the petitioner is that cousin sister of the petitioner filed Complaint Case bearing Complaint Case No. 1608 C of 2013 against the police officials of Kadam Kuan police station prior to institution of the present case and that

Patna High Court Cr.Misc. No.36258 of 2016 (2) dt.23-08-2016 2/2 is the reason of false implication of the petitioner in the present case as well as some other cases.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Patna in connection with Kadam Kuan P.S.Case No. 73 of 2016.
