JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this court but submission on behalf of the petitioner is that having more or less similar allegation, co-accused, Jhunnu Kumar has already been granted privilege of bail whereas petitioner is in jail custody since 21.05.2014. Considering the period of detention of the petitioner in jail custody as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.33512 of 2016 (2) dt.31-08-2016 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Nawada in connection with Sessions Trial No. 315 of 2014 arising out of Nawada Town P.S. Case No. 261 of 2014.
