The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 and 411 of the Indian Penal Code.

As per the prosecution case, on the petitioner and one another having looted the informant, his tractor and the articles mentioned in the FIR, it is stated that on hulla being raised both the accused persons were caught and the looted articles recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case due to a misunderstanding. No incriminating article has been recovered from his possession. He is in custody since 27.12.2020 and has no criminal antecedent. Chargesheet has been submitted in the

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 11 months and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Sugauli P.S. Case no. 652 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari.
