This Court would expect that the petitioner's Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office. Petitioner seeks bail in connection with Bairgania P.S. Case No. 154 of 2020 registered under Sections 341/323/324/326/354A/307/504/34 of IPC.
The petitioner's counsel submits that petitioner has now remained in custody for two years.
Since, there is an allegation of brutal assault by means of Dabiya on Arman Ansari, this Court had called for a report regarding the status of the trial.
Patna High Court CR. MISC. No.19756 of 2022(5) dt.10-08-2022 2/2 The report received from the trial court dated 07.07.2022 states that five witness have been examined out of eight chargesheeted witnesses.
In the circumstances, having regard to the progress in the trial, the heinous offences, the Court is not inclined to take a different view than what was taken in Cr. Misc. No. 14821 of 2021, when the petitioner's prayer for bail was earlier rejected on 05.10.2021.
This application is rejected with observation that the trial court should proceed in the matter expeditiously without granting any unnecessary adjournment or undue delay, in accordance with law.
