JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 392 of the I.P.C.

The prosecution story, in brief, is that on the alleged date and time of occurrence the informant was doing his work in the Branch of Madhya Bihar Gramin Bank, in the meanwhile three persons concealing their face by white gamchha have entered into the grill gate armed with pistols and then one person was standing near the gate and two persons looted away Rs.1,03,000/- from the counter and fled away. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.3.2016 and the charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.28368 of 2016 (4) dt.30-08-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. He has been made accused on the basis of confessional statement of co-accused. The petitioner has not been put on Test Identification Parade. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kinjar P.S. case No.20 of 2014.
