1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Khaira P.S. Case no. 76 of 2024, registered under sections 307, 147, 149, 341, 323, 325, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the five named accused persons including the petitioners herein abused and assaulted him. It is stated that while the petitioner no.2 and one another caught hold of the informant, Rahul Mandal and Uttam Mandal assaulted the informant with an iron rod causing injuries.

4. Learned counsel for the petitioners submits that

The allegations of assault is specific on Rahul Mandal and Uttam Mandal and not on the petitioners herein. Referring to the statement made in paragraph no.11, it is submitted that the doctor found the injuries to be simple. Further, coaccused Rahul Mandal has been enlarged on bail vide order dated 6.8.2024 passed in Cr. Misc. no.48104 of 2024. The petitioners have no criminal antecedent and undertake to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioners in the F.I.R, grant of bail to co-accused Rahul Mandal vide aforesaid order dated 6.8.2024 and the petitioners not having any criminal antecedent, it is directed that both the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Khaira P.S. Case no. 76 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten
