Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323/34 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.
It is alleged that the petitioner no. 1 namely Kanhaiya Choudhary, quarreling with the husband of the informant, which was protested by the son of the informant, then petitioner no. 1 assaulting the son of the informant. When the informant made protest, then accused Indul Choudhary @ Indul Kumar and Bihari Choudhary assaulted the informant and abused by calling caste name.
Patna High Court Cr.Misc. No.33784 of 2015 (2) dt.31-08-2015 It is submitted by the learned counsel for the petitioners that dispute with regard to accounting of the money, the accusation have been levelled and subsequent to the lodging of the First Information Report the complaint case was filed. It is submitted that no injury was caused to the informant's side. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Sikroul P.S. Case No. 49 of 2015, pending in the court of learned Chief Judicial Magistrate, Buxar.
With this observation this application is disposed of.
