2. The petitioners apprehend their arrest in a complaint case registered for the offence punishable under Section 498A of the Indian Penal Code.
3. As per the prosecution case, there is allegation of matrimonial cruelty and demand of dowry.
4. It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.26553 of 2024(4) dt.20-08-2024 2/3 that Petitioner No. 1 is father-in-law, Petitioner No. 2 is motherin-law and Petitioner Nos. 3, 4 and 5 are sisters-in-law of the complainant/Opposite Party No. 2 and they are separate in mess & property and have got no concern with the affairs of the complainant and her husband. Allegations are general and omnibus. Thrust of the accusation is against husband of the complainant/Opposite Party No. 2. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of complainant/Opposite Party No. 2 have vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts and circumstances, nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Katihar, in connection with Complaint Case No. 740 of 2021, subject to condition as laid down under Section 438(2) of
Patna High Court CR. MISC. No.26553 of 2024(4) dt.20-08-2024 3/3 the Code of Criminal Procedure.
