JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-07-2020 Heard Mr. Mukesh Kumar Rana, learned Advocate for the petitioner and Mr. Pradip Narayan Kumar, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Sikty P.S. Case No. 84 of 2019 dated 11.06.2019 instituted for the offences under Sections 147, 148, 149, 224, 225, 341, 323, 324, 332, 333, 353, 307 and 504 of the Indian Penal Code. It has been submitted on behalf of the petitioner that though he is named in the FIR but his name has transpired in the confession of an arrested accused person viz. Md. Mushtaq. Apart from this, there is no other material to the connect the petitioner with the offence. One of the accused persons of this case has been granted anticipatory bail by a Bench of this Court.
Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest/surrender before the court below within a period of six weeks, on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Araria in connection with Sikty P.S. Case No. 84 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
