JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354 of the Indian Penal Code and 8 of the PASCO Act.
It is alleged that the petitioner tried to outrage the modesty of the informant and when the informant and her mother went to make protest, the petitioner threatened them of dire consequences.
It is submitted by learned counsel for the petitioner that petitioner is witness in Paraiya P.S. Case No. 22 of 2015 and Paraiya P.S. Case No. 35 of 2015 where one of the accused is relative of the mother the informant and the petitioner is witness in those cases. Hence he has falsely been implicated in the present
Patna High Court Cr.Misc. No.34357 of 2015 (2) dt.17-08-2015 2/2 case. There is nothing on record to suggest that the informant was put to medical examination. The occurrence took place on 21.06.2015 and the FIR was lodged on 22.06.2015. The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Paraiya P.S. Case No. 55 of 2015 pending in the Court of learned Addl. District Judge 1st, Gaya. With the observations above, the application stands disposed off.
