JUSTICE SHIVAJI PANDEY ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 399, 402, 413, 414/34 of the Indian Penal Code and Sections 25(1-B)A, 26 and 35 of the Arms Act.

As per allegation petitioner and his associates were arrested. Allegation has been made that they were preparing to commit crime.

From the order-sheet it appears that petitioner is Bangaladeshi citizen and illegally he has entered in the Indian territory. Other persons, namely, Md. Abdul Malik and Khurshid Ahmad @ Pappu have been granted bail by this

Patna High Court Cr.Misc. No.32565 of 2016 (3) dt.20-08-2016 Court vide Cr. Misc. No. 31462 of 2016 and 21452 of 2016 respectively.

In this view of the matter, let petitioner, Md. Raja, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in Siwan (Town) P.S. Case No. 202 of 2016.

As there is a statement of fact that petitioner is a Bangaladeshi, so the Superintendent of Police, Siwan is directed to take action for expelling the petitioner from Indian territory.
