The petitioners have preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, while the informant and other police personnel proceeded to conduct a raid on receiving information about storage of illicit liquor, it is stated that the five named accused persons including the two petitioners herein came armed with lathi, danda etc., assaulted the police personnel and obstructed them in carrying out their official work.

They are in custody since 17.1.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioners having remained in custody for over 10 months, the Court directs both the petitioners to be enlarged on bail in connection with Madhwapur P.S. Case no.11 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Benipatti, DistrictMadhubani.
