The petitioner no.1 being the elder brother of the husband of victim and petitioner no.2 being wife of petitioner no.1 are apprehending arrest in a case registered for the offences punishable under Sections 304B, 498A and 328/34. The accusation is of killing the niece of the informant after one year of marriage for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the entire inlaws family and the petitioners claim to be separate from the husband of the victim. During investigation it has also transpired that the petitioners used to reside in a different village.
Patna High Court Cr.Misc. No.33868 of 2015 (2) dt.26-08-2015 2/2 Considering the thrust of accusation against the husband of the victim and as per submission of the counsel for the petitioners, the husband is in custody, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Supaul in connection with Triveniganj P.S. Case No.112 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
