====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-04-2025 Heard learned counsel for the petitioner and the State.
2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 109, 118(1), 74, 303(2) and 352 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, all the FIR named accused persons including this petitioner assaulted informant and his family members with rod, tangi, lathi danda. Petitioner is alleged to have assaulted on the head of Devanand with tangi.
4. Learned counsel appearing for the petitioner submits that due to petty dispute, altercation took place between the parties in which both sides sustained injuries. Doctor has found simple injury. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer
Patna High Court CR. MISC. No.18135 of 2025(2) dt.10-04-2025 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Saran at Chapra in Kopa Police Station Case No. 119 of 2024, subject to the conditions laid down under section 482 of the the Bharatiya Nagarik Suraksha Sanhita, 2023.
