Petitioner is seeking anticipatory bail in connection with Special Case No.11080 of 2018, arising out of Ramkrishna Nagar P.S. Case No. 439 of 2018, registered for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case without there being any material to involve in the present case. On perusal of the records, it appears that in course of raid when the petitioner was fleeing away his mobile phone fell down which was seized by the police. The people also identified him. Further it is found that earlier also for the same offence he

Patna High Court CR. MISC. No.18219 of 2019(2) dt.01-04-2019 2/2 was arrested by police and then he was on bail. Considering the entire facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner particularly when for the similar allegation there is one more case and he was on bail and that mobile phone of the petitioner was recovered while he was fleeing away. His prayer is refused. In case, the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on its own merit without being prejudiced by the order of this Court.
