JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 This is an application for grant of anticipatory bail in connection with Brahampura P.S. Case No.390 of 2018, disclosing offences under Sections 363, 366(A), 34 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is that minor daughter of the informant has gone to market and thereafter, she was trace-less. Later on, informant came to know about the names of the accused Md. Nehal, Md. Afique Raza @ Hira and Md. Shahid @ Munni. The girl has been recovered and she has also supported the prosecution case.
Submission of the learned counsel for the petitioner is that petitioner happens to be the mother of accused Md. Nehal and allegation against her is that she was taken by Md. Nehal and kept in his house and except that there is no allegation
Patna High Court CR. MISC. No.18439 of 2019(3) dt.18-06-2019 2/2 against the petitioner, who is lady.
Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that girl is minor.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Brahampura P.S. Case No.390 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
