JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 25 (1-A) (1-B)ac, 26 (1)(2)(3)/ 35 of the Arms Act On secret information to the effect that some miscreants are manufacturing illegal arms, a raid was laid when some semifinished arms were recovered and two persons namely, Pradip Paswan and Santosh Kumar were apprehended, who named several persons including the petitioner, as a person escaped from the scene.

It is submitted by learned counsel for the petitioner the petitioner has no criminal antecedent, a statement to that effect has been made in paragraph 3 of the petition. There is no recovery from the petitioner and except the confession of the co-accused no

Patna High Court Cr.Misc. No.35215 of 2015 (2) dt.20-08-2015 2/2 material has been collected, during investigation. Moreover, similarly situated co-accused Md. Sintu has been granted bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.20029 of 2014.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Dharhara P.S. Case No.121 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
