Md. Aslam Ansari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-04-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 74, 109, 352, 351(2) and 351(3) of the B.N.S. and Section 27 of the Arms Act.

The prosecution case, in brief, is that on 04.12.2024 at about 12:45 in the midnight, these petitioners and their associates misbehaved with the dancers who were dancing in the marriage function of informant's cousin and on being objected, co-accused Saroj Yadav and Anuj Kumar opened fire causing fire arm injury in the right hand of informant.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. From bare perusal of the F.I.R. it is apparent that specific accusation of causing fire arm injury is against co-accused Saroj Yadav and Anuj Kumar and there is no allegation that these petitioners caused any fire arm injury to anyone. There are general and omnibus allegations against these petitioner. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the general and omnibus nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Koilwar P.S. Case No. 470 of 2024,
