JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
The alleged occurrence appears to have taken place on account of cutting the bamboo trees and it is stated that petitioner gave farsa blow causing injury on the head and waist of the informant's husband and after that other accused assaulted the informant's husband by different weapons. The injury report of informant's husband goes to show that altogether seven injuries were found on his person but all the injuries, except two injuries, were found simple in nature and so far as the above stated two
Patna High Court Cr.Misc. No.28522 of 2016 (2) dt.18-07-2016 2/2 injuries are concerned, opinion regarding the nature of aforesaid injury was kept reserved but even after lapse of more than two months, the investigating officer could not succeed to collect the complete injury report. Moreover, there is case and counter case between the parties and it appears that persons from both the sides sustained injury.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S. Case No. 185 of 2015.
