Petitioner seeks bail in Pakaridayal P.S. Case No.43 of 2018 instituted for the offence under Section(s) 120-B, 121 Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act, Section 17 of the CLA Act and Sections 10, 11, 13 of UAPA Act.

Counsel for the petitioner submits that petitioner is in custody since 27.03.2018. He has no criminal antecedents. As per seizure list, one country made pistol was recovered from his possession.

Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let

Patna High Court Cr.Misc. No.53999 of 2018 (2) dt.03-10-2018 2/2 the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, V, Motihari, in connection with Pakaridayal P.S. Case No.43 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. The petitioner will remain present on each and every date of trial and his absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled.
