The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 346 of 2018 for the offences punishable under Section 379 of the Indian Penal Code.

The allegation is regarding the motorcycle of the informant having been stolen by unknown miscreants. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on the confessional statement made by the co-accused, namely, Awadhesh Kumar. It is further submitted that neither any recovery has been made from the petitioner nor the stolen motorcycle has been recovered from the house of the petitioner.

The petitioner is stated to be languishing in custody since 25.9.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIII, Bhagalpur in connection with Kotwali P.S. Case No. 346 of 2018.
