SINHA ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner, the State and the counsel for the informant.
2. Petitioner is apprehending his arrest in connection with a case registered for the offences under Sections 406, 409, 420 of the Penal Code and Section 138 of the Negotiable Instruments Act as cheque of Rs. 10 lakhs issued by him has bounced.
3. Let petitioner deposit a sum of Rs. 10 lakhs in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below. No sooner petitioner deposits the aforesaid amount, he be released on bail on furnishing bail bond of Rs. 5,000/-(Five Thousand) with two sureties of the like amount each to the satisfaction of Chief
Patna High Court Cr.Misc. No.35036 of 2014 (2) dt.20-02-2015 2/2 Judicial Magistrate, Purnia in connection with K.Hat (Sahayak) P.S. Case No. 261/14, subject to the condition laid down under Section 438(2) Cr.P.C. whereafter Rs. 5 lakhs shall be withdrawn by the complainant and the remaining Rs. 5 lakhs shall be invested by the court below in fixed deposit with a Nationalized Bank and whoever succeeds in the trial shall be entitled not only to get the said amount but also the interest earned over the same.
