The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, the petitioner and two others are stated to have assaulted Tarik Anwar @ Bittu and Rinku. It is further state that six other accused persons assaulted Manauwar Hussain who subsequently died.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The case of the petitioner stands on a similar footing to that of coaccused Mukhtar Ansari and Haidar Ansari who have been enlarged on bail vide order dated 3.12.2020 passed in Cr. Misc. no.31319 of

Patna High Court CR. MISC. No.28928 of 2021(3) dt.03-01-2022 2/2 2020 and order dated 8.1.2021 passed in Cr. Misc. no.31237 of 2020. The petitioner is in custody since 20.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for over 11 months and grant of bail to the above mentioned two accused, the Court directs the petitioner to be enlarged on bail in connection with Taraiya P.S. Case no. 84 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st , Saran at Chapra.
