Petitioner seeks bail in connection with Bairgania P.S. Case No. 92 of 2019 registered for the offences punishable under section 147, 148, 149, 341, 323, 504, 353 of the Indian Penal Code and sections 30(A)/34 of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this due to enmity merely on basis of suspicion. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern either with the recovered wine or articles. Petitioner

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of learned IInd Addl. Sessions Judge-cum-Special Judge, Excise Act, Sitamarhi in connection with Bairgania P.S. Case No. 92 of 2019.
