Mr. Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 02-11-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 406, 420, 379, 500, 506 and 34 of the Indian Penal Code. The learned counsel for the petitioners submits that the petitioner nos.2, 3, 4 and 6 are persons with clean antecedent

Patna High Court CR. MISC. No.20930 of 2022(2) dt.02-11-2022 2/3 and petitioner nos.1 and 5 have antecedent of one case filed by the complainant. It is next submitted that the crux of the allegation as alleged in the F.I.R. is to the effect that in between the complainant and her husband along with her in-laws, there is a matrimonial dispute and matrimonial relations between them are not on good terms. There is allegation of abuse, torture of the complainant by the accused persons and the complainant even was deprived of her Stridhan.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. It is next submitted that the allegations are general and omnibus in nature. It is also submitted that petitioner no.1 is the mother-inlaw, petitioner no.2 is brother of petitioner no.1, petitioner no.3 and 5 are daughters of petitioner no.1 and petitioner no.4 and 6 are son in-laws of petitioner no.1. It is thus submitted that the complainant, on account of dispute with her husband, has falsely implicated the entire family members. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail

Patna High Court CR. MISC. No.20930 of 2022(2) dt.02-11-2022 3/3 on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Complaint Case No.444 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
