Let the defect(s), if any, be removed within a period of four weeks.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is a young boy with clean antecedent and the deceased was found dead in his house and the accused persons including the petitioner were suspected of killing the deceased. It is further submitted that during the course of investigation, no material came to connect the petitioner with the offence as the deceased had died in his house and no one had seen the petitioner entering or exiting the house of the deceased. Learned counsel next submits that though petitioner is

No.19912 of 2022(3) dt.20-10-2022 2/2 named in the FIR but the informant is not an eyewitness to the occurrence nor has stated that he has seen the petitioner entering or exiting the house. It is also submitted that informant being father of the deceased also has alleged that the alleged occurrence took place on account of dispute relating to money. It is further submitted that petitioner is similarly situated like co-accused Dayanand Malah @ Sadanand Kumar who was granted the anticipatory bail vide order dated 26.04.2022 passed in Cr. Misc. No. 19848 of 2022. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Gopalpur P.S. Case No. 373 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
